The following are the online shopping terms and conditions for our DEN'GOLF® better swing® products. Purchase can only be done online on the website www.concept-golf.com. The owner of this website is Mr. Raymond Denancé.

EFFECTIVE LAW

The seller and the customer agree on the present contract under French Law.

The terms and conditions are written in French. There is an English translation to help our English customers but only the French version is the legal one.

MODIFICATION

The seller has the right to change the terms and conditions at any time. The customers read and accept the terms and conditions as they are shown on the website when ordering.

ARTICLE 3 : ESSENTIAL CHARACTERISTIC OF THE ITEMS FOR SALE

The products concerned are described on the page "online webshop" (for the English version).

The geographical and delivery zone for a sale is worldwide but the seller has the right to refuse delivery in some countries depending on the information he receives from the transporters.

When ordering, it is possible to check if the item is available by checking on the opening page of the webshop.

Users advice is supplied with the products.

Delivery service : transport is done by transport companies. The seller gives a quote for the transport to each customer for approval.

Guarantee

A one-year guarantee for labor and spare parts is supplied with DEN'GOLF reference 101. It is provided by the seller. If a product, which is still under guarantee, is sent back to the seller, the return postage is paid by the customer.

Available, unavailable products

The seller will notify the customer when the product will be sent from the factory.

If an item is unavailable after it has been ordered, the customer will be notified by email or by post. The customer can either cancel the order and receive repayment by return or wait until the item becomes available again.

ARTICLE 4 : TERMS AND CONDITIONS OF SELLER'S CONTRACT WITH THE CUSTOMER

The seller offers the customer the following terms and conditions on his website. He guarantees the sale of his products as long as they are available online.

It is possible for the customer to correct any mistakes he made while ordering online by acceding his personal details, protected by his password, before confirming an order.

ARTICLE 5 : DETAILS OF THE COST OF PRODUCTS ON SALE

The prices shown on the opening webpage online is given in euros excluding tax (EUR HT).

Value added tax is calculated on the basis of the legal French rate on all deliveries to countries in European Union (EU).

Products that are delivered outside the EU and DOM/TOM, the prices are calculated excluding tax on the invoice. Tariffs, local tax and import duties are likely to be due. The customer must make inquiries concerning these issues with the local authorities in that country.

Delivery costs

As mentioned above in article 3, for each delivery a quote will be sent to the customer by the seller.

ARTICLE 6 : CONCLUSION OF CONTRACT ONLINE

Prior formalities

Before the customer confirms that he accepts the agreement he must check the details of his order.

Any possible errors can be corrected or the initial order can be changed.

If the customer accepts the delivery quote, he takes note of the price to pay, according to the country where delivery will be made.

A pro forma invoice with all the details concerning the order is available on the customers page online: name and address of seller, details of the order, delivery charges, amount to pay, payment method.

Confirmation of the order by the customer

The customer, when confirming his order, chooses the payment method and agrees with this terms and conditions.

Electronic acknowledgement of receipt of the order

The seller sends the customer an electronic acknowledgement of receipt of his order as soon as possible. This formality confirms that the customer's order has been registered by the seller.

ARTICLE 7 : PAYMENT

Payment can be made by using one of the following methods:

1. either directly by credit card, in this case, payment is irreversible.

2. or by deferred payment, bank transfer or check. Checks will be accepted only if the account is in a bank domiciled in France.

In both cases, the order will be delivered as soon as the payment is cashed by the seller's bank.

ARTICLE 8 : RIGHT TO RETRACT AND DELAY

According to the French law, the customer has the right to retract within a period of seven (7) days after the date of delivery. The product bought online must be returned complete to the seller. The customer will not have to justify his decision to return the product or pay a penalty. Only the return costs will have to be paid.

However :

- the seller will refuse to reimburse the products if they are not returned within the period of 14 days,

- any damaged product or if it is returned without the original package will be reimbursed with a minoration depending on the damage.

The customer (sender) is responsible for the transport costs and risks for the return of the product. Any lost product when returned will not be reimbursed.

REIMBURSEMENT METHOD

When the returned product reaches the seller, acknowledgement of receipt will be sent by email to the customer and the product will be reimbursed by check or bank transfer (depending on the seller) within a period of 30 days from the date of delivery.

ARTICLE 9 : DELIVERY OF ITEMS

The items ordered will be delivered within 30 days after ordering, except in the case of a major problem, unless the contract is cancelled and the amount paid is reimbursed.

For claims, the customer must send his complaint by letter, either by post, fax, email, etc. to the address mentioned in Article 2.

In the event that a parcel is refused when delivered or sent to the wrong address given by the customer. When the items are returned to the seller they will be reimbursed but the post sent and returned will be deducted from the amount.

ARTICLE 10 : PERSONAL DETAILS

The seller will conserve the personal details of his customers. These details will under no circumstances be given to anyone.

According to the French law, the customer can at any time access, cancel or change his personal details. The customer can send any claims to the distributor by using the address given in Article 2.

ARTICLE 11 : SETTLING DISPUTES

The seller and the consumer can choose between the following ways to solve disputes.

Clause of mediation

The disputes that can arise concerning the validity, interpretation, application or non-application, interruption or cancellation of the present contract will be sent under the mediation rules to the CMAP (Centre de Médiation et d'Arbitrage de Paris), to which the seller and customer declare to subscribe.

Clause of online recommendation

The disputes that can arise concerning the validity, application or non-application, interruption or cancellation of the present contrat will be sent to the online recommendation of the CMAP (Centre de Médiation et d'Arbitrage de Paris), to which both members declare to subscribe.

Clause referring to the common law

If there is no agreement or mediation, the competent regional court for disputes is the Tribunal de Commerce de Bonneville (Haute-Savoie, France).
